REQUIREMENTS, REGULATIONS AND RULES
1. The Guest listed on the front of this Agreement and signing the same agrees to take
full responsibility for the actions, inactions and property of him- or herself, as well as all persons using the Site. Guest
warrants that he or she has full authority to execute the Agreement on behalf of any entity/group using the Site.
Guest further agrees to pay all rental amounts and additional costs on the itemized billing statement provided by Farmhouselife,
L.L.C. Copies of this document are available upon request.
2. For the purposes of this
Agreement, the "Premises" shall be defined as any and all real property, buildings and natural features
located at 2244 U Ave., Rippey, Iowa 50235. For the purposes of this Agreement, all persons using the Site shall
be referred to as "Subguests." For the purposes of this Agreement, Kevin Wilbeck and Christine Wilbeck
shall be referred to as "Wilbecks."
3. Guest shall pay for any damage to the Sites and their contents occurring during the use of the Site. If
any damage to or on the Premises results from any act or negligence of Guest or Subguests, Guest shall repair the damage within
12 hours of the occurrence of the damages. If Guest fails, refuses or is unable to make the repairs, Guest shall pay to Farmhouselife,
L.L.C., the total cost of the repairs and damages. Payments for such damage shall be paid in full prior to Guest vacating
the Site, unless otherwise agreed to in writing by the parties.
4. Farmhouselife,
L.L.C., and its managers, agents and personnel, as well as Wilbecks, separately and collectively, shall not be liable, and
Guest waives all claims, on behalf of itself and Subguests, for any and all injuries or damages to person or property sustained
by Guest or Subguests, resulting from: A. Any part of
the Premises, including any Site, building, equipment or appurtenances thereon, in need of repair; B. Any accident in or about the Premises; or C. Any injury or damage resulting directly or indirectly from any act or negligence of another guest or occupant of the
Premises or of any other person. Furthermore,
Farmhouselife, L.L.C., its managers, agents and personnel, as well as Wilbecks, shall not be responsible for the personal
property of the Guest and Subguests, nor liable for damage or theft of such property. All personal property
belonging to or possessed by Guest or to any Subguest that is on the Premises shall be there at the risk of Guest or Subguest
only. Guest and all Subguests are required to have medical insurance prior to using or occupying any part
of the Premises.
5. Guest further agrees that Farmhouselife, L.L.C., its managers, agents and personnel,
as well as Wilbecks, shall not be liable, and Guest and Subguests waive all claims, for any and all injuries or damages to
person or property sustained while a passenger of or on any form of conveyance provided for use by Guest and Subguests, whether
owned exclusively by Farmhouselife, L.L.C., or contracted by Farmhouselife, L.L.C., for the convenience of Guest or Subguests,
including, but not limited to, bicycles, cars, trucks, vans, motorized carts or all-terrain vehicles, taxis or buses.
6. Guest,
on behalf of him- or herself, as well as all Subguests, shall indemnify and hold Farmhouselife, L.L.C., its managers, agents
and personnel, as well as Wilbecks, harmless from and against any and all liability for damages, costs, losses, and expenses
resulting from, arising out of, or in any way connected with, the occupation or use of Premises by the Guest, or the licensees,
invitees, or guests of the Guest, or the failure on the part of the Guest to perform fully the Guest’s promises contained
in this Waiver of Liability and Release.
7. Guest and Subguests grant to Farmhouselife, L.L.C., and to Wilbecks, the right
to their images and names in all forms and media for any commercial purpose. Guest, on behalf of him- or herself, as well
as of any Subguest, hereby waives the right to inspect or approve versions of any image used for publication or the written
copy that may be used in connection with the images. Guest hereby releases Farmhouselife, L.L.C., and Wilbecks
from any claims that may arise regarding the use of Guest’s image, and agrees to indemnify and hold harmless Farmhouselife,
L.L.C., and Wilbecks from any action brought by any Subguest for any such claims. 8. In the event that the Guest’s use of the Premises and/or Site is made open to
the public, Guest agrees to obtain liability insurance covering the planned event. Such insurance policy
shall include Farmhouselife, L.L.C., and Wilbecks as additional insureds, and Guest shall provide a certificate of insurance
to Farmhouselife, L.L.C.
